This contract has been prepared in accordance with the Distance Contracts Regulation published in the official gazette on 27.11.2014 and Articles 48 and 84 of the Law on Consumer Protection dated 7.11.2013 and numbered 6502, on which this regulation is based.

ARTICLE 1 – Subject, Parties and Definitions

This agreement is signed with Su Polat Psychology Services for those who want to receive psychological counseling services provided by Expert Psychologist Su Polat (hereinafter referred to as the "consultant") over the topics on the www.psysupolat.com website, and can apply by filling out the make an appointment form at www.psysupolat.com. The giver is between the natural person (hereinafter referred to as the “client”). The parties declare, accept and undertake that the information written in this contract is correct.

ARTICLE 2 - Duration of the Contract

In order to provide the services that are the subject of this contract, the specified rights and obligations of the parties begin with the payment of the consultancy fee of the counselee, who is planned to meet with the consultant by making an appointment on www.psysupolat.com and ends with the delivery of the selected service.

ARTICLE 3 – Value of the Contract

The fee to be paid for the services specified in this contract is the amount specified on the relevant service page of the www.psysupolat.com website. The stated prices include VAT. The Client will make the fee specified in the service to be selected from the services that constitute the subject of this contract by directing him to the payment page on the website.

ARTICLE 4 – Rights and Responsibilities of the Parties:

a) Rights and Responsibilities of the Consultant:

– The aim of Su Polat Psychology Services, which provides remote psychological counseling service, is to provide psychological assistance and supportive counseling service to the person through visual, audio or written communication channels.

– Distance counseling service is not a medical treatment service, although it does not contain the purpose of diagnosis (diagnosis) and treatment related directly or indirectly to mental illnesses. Applications such as starting drug therapy, adjusting the dose or discontinuing drug therapy are not performed.

– Required name, surname, telephone, etc. entered when receiving consultancy service on www.psysupolat.com. The confidentiality obligation of the information belongs to Su Polat Psychology Services.

– What is spoken in the interviews remains between the counselor and the client, within the framework of the principle of confidentiality. This is not valid, however, when the client harms himself or someone else, and the counselor can share information about the client with those he deems necessary.

– Remote consultancy service is carried out according to the principle of confidentiality. The identity information of the client is kept confidential and is not shared with third parties. It is shared with the competent authorities only if requested by the prosecutor's office and the security unit. Conversations made by telephone, instant messaging programs or video are never recorded, listened to, and interviews are not made under observation without the client's consent.

– In online payments, in case the card is used unlawfully by someone other than the holder, in accordance with the provisions of the Bank Cards and Credit Cards Law No. 5464 dated 23.02.2006 and the Regulation on Debit Cards and Credit Cards published in the Official Gazette dated 10.03.2007 and numbered 26458. transaction is done.

– The client has accepted to receive all messages sent by Su Polat Psychology Services to the e-mails and telephones that he/she reported while becoming a member. Su Polat Psychology Services may use the e-mail and mobile phone numbers reported by the buyer in their commercial ventures. In case of changes in e-mails and telephones, this will be reported to Su Polat Psychology Services. Otherwise, all information and update messages sent through the website will continue to be sent to the e-mails and phones declared during registration.

– Client information can be anonymized by the advisors and used for academic purposes.

– The counselor has the right to terminate the service if he/she determines that the remote meeting is not suitable for the situation and/or does not provide benefits during the counseling process with the client, and has the right to terminate the interview if he/she is exposed to verbal and/or sexual harassment.

– The counselor will not provide psychiatric medication or medical practice and will not provide psychiatric attack or crisis intervention services.

– If the counselor determines that drug treatment is necessary along with psychotherapy during counseling, he will direct the client to a psychiatrist.

b) Client Rights and Responsibilities:

– In order to receive remote consultancy services: to be of age (over 18 years of age), the person must not have a situation that may prevent him from making and implementing his own decisions, and that may require legal guardianship, and the person must not be in conflict with the provisions of this contract for any other legal reason.

– In case the person is legally underage, in severe mental disorders, in psychiatric problems that require drug treatment, in cases where the person is at risk of suicide and in cases involving criminal elements in terms of legislation, remote consultancy service is not provided.  Those who want to receive consultancy services are listed above. They are deemed to have accepted that they are not in the situations and that they are aware of the limits of the service. The age of the client, etc. Su Polat Psychology Services is not responsible for any situation that may arise in cases where the consultant misleads the counselor in important matters. When such a situation is noticed, the consultant has the right to interrupt the service and not to refund the fee.

– Remote consulting service is personal. The fee for the usage packages on the site covers the use of a single user and the right of use cannot be transferred to third parties and institutions. Counseling service procurement or membership cannot be performed by the spouse, sibling, any of the family members or anyone else without the person's knowledge.

- There is no refund in case of not participating in the remote consultation, which will be made in the form of video, audio or messaging at the appointment time. It is the client's responsibility for being late or left unanswered. In this case, the client cannot ask for additional time.

– Unless the client notifies the consultant that he has canceled the service 48 hours in advance, he cannot request a refund for the missed meeting.

–  Su Polat Psychology Services is not responsible for missed or late appointments due to technical reasons. In such cases, which may occur due to technical reasons, the decision to reschedule the appointment free of charge is at the discretion of the consultant.

– The counselee must be at the computer at the counseling hour agreed with the counselor. During the interview, the client is expected to be alone and to ensure silence and privacy. The client also has to ensure that there will be no noises and distractions that may hinder the conversation, and that there will be no interruptions or interruptions due to mobile phone use and mobile phone use during the conversation.

– The client cannot take and use audio or video recordings of the conversations without the consent of the consultant.

– In case the client cannot make the interviews with a computer, tablet or mobile phone that belongs to him, if a shared computer is used with another user, he/she should keep the history feature of the browser turned off and delete the site he/she visited from the history following the use, accepts that there are inconveniences in terms of security and that unwanted recordings may occur.

– The client is responsible for the security of user name and access passwords, e-mail username and access passwords. Su Polat Psychology Services is not responsible for any damages that may arise due to the possession of the said information by third parties.

ARTICLE 5- Right of Withdrawal (Return Conditions)

– It is not possible to reimburse the remote consultancy service provided by the consultant and the consultant within the scope of the contracts regarding the services performed instantly in the electronic environment and the intangible goods delivered to the consumer instantly.

– When it is clear that you will not be able to attend the scheduled meeting, you are expected to cancel your appointment 48 hours before the appointment time. In case of cancellations made in the last 48 hours or in sessions where you do not attend without notice, your right to that meeting will be lost. In cases where notification is given before 48 hours, a new meeting time can be determined or full refund can be made according to the client's request.

ARTICLE 6 – Notifications and Disputes

– For all kinds of notifications arising from the contract subject to the parties, the e-mail address to be given by the client and the address specified at https://www.psysupolat.com info@psysupolat.com have accepted, declared and committed to the postal address  as legal residence

– In all kinds of disputes that may arise from this contract and its implementation; Consumer Arbitration Committees and Consumer Courts are in charge according to the monetary limit stipulated by the current legislation. Istanbul Courts and Enforcement Offices are authorized for the final resolution of disputes at the monetary border.

– This contract has been read, understood and signed by the parties. It is considered that the application to be signed is realized by sending the application to Su Polat Psychology Services on the internet. Su Polat Psychology Services may add, remove or make changes to new items and/or sub-headings if deemed necessary. The Client declares and undertakes that he has accepted these changes in advance.

ARTICLE 7 – Retention of Information and Documents

Su Polat Psychology Services is obliged to keep the information and documents related to each transaction regarding the right of withdrawal, notification, delivery and other obligations for 3 years.

ARTICLE 8 – Enforcement

This contract, which consists of 8 (eight) articles, was read by the parties and concluded by being read by the client in electronic environment and entered into force immediately.
